CAPITANO Terms of Service
Welcome to CAPITANO ("CAPITANO," "we," "our," or "us").
CAPITANO provides a platform that helps amateur athletes, teams, captains, organizers, and communities coordinate participation in sports activities. By accessing or using the CAPITANO website, mobile application, or services (collectively, the "Services"), you agree to these Terms of Service.
1. Eligibility
You must be at least 18 years old, or have permission from a parent or legal guardian, to use the Services.
You are responsible for ensuring that your use of the Services complies with applicable laws.
2. Nature of the Service
CAPITANO is a technology platform that facilitates communication, organization, scheduling, attendance tracking, and discovery of amateur sports activities.
CAPITANO does not organize, host, supervise, manage, sponsor, operate, or control any games, matches, tournaments, teams, venues, leagues, or sporting events.
All sports activities are organized and conducted solely by users and third parties.
3. Assumption of Risk
Participation in sports and physical activities involves inherent risks, including serious injury, disability, illness, property damage, or death.
By using CAPITANO and participating in any activity discovered or coordinated through the Services, you voluntarily assume all risks associated with participation.
You are solely responsible for determining whether any activity is appropriate for you.
4. Release of Liability
To the maximum extent permitted by law, CAPITANO, its founders, officers, employees, contractors, affiliates, and partners shall not be liable for:
- Any injury, illness, disability, or death
- Property loss or damage
- Accidents or collisions
- Player conduct or misconduct
- Assault, harassment, or disputes
- Venue conditions
- Event cancellations
- Scheduling errors
- Third-party actions
- Any incident occurring before, during, or after any sporting activity
Your participation in any activity is entirely at your own risk.
5. User Conduct
You agree not to:
- Violate any law or regulation
- Harass or abuse other users
- Share false information
- Impersonate another person
- Use the Services for fraudulent purposes
- Interfere with the operation of the platform
We reserve the right to suspend or terminate accounts at our discretion.
6. User Content
You retain ownership of content you submit to CAPITANO.
By submitting content, you grant CAPITANO a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute such content for operation and improvement of the Services.
7. Communications
By creating an account, joining a team, accepting an invitation, or opting in to communications, you agree to receive transactional messages related to team participation, attendance, scheduling, invitations, and account activity.
Message and data rates may apply.
You may opt out of SMS communications by replying STOP.
8. Third-Party Services
CAPITANO may integrate with third-party services, including messaging providers, payment processors, maps, analytics providers, and other technologies.
We are not responsible for third-party services or their actions.
9. Disclaimer of Warranties
The Services are provided "as is" and "as available."
CAPITANO makes no warranties regarding availability, reliability, accuracy, safety, or suitability of the Services.
10. Limitation of Liability
To the fullest extent permitted by law, CAPITANO's total liability arising from or related to the Services shall not exceed $100 USD.
In no event shall CAPITANO be liable for indirect, incidental, consequential, special, exemplary, or punitive damages.
11. Indemnification
You agree to defend, indemnify, and hold harmless CAPITANO and its affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from:
- Your use of the Services
- Your participation in sports activities
- Your interactions with other users
- Your violation of these Terms
